It is primarily designed for use by counsel for the plaintiff. It deals with divorce and all other relief in a family law proceeding under the Divorce Act, R.S.C. 1985, c. 3 (2nd Supp.), and the Family Relations Act, R.S.B.C. 1996, c. 128 (the “FRA”). It should be used in conjunction with other relevant practice checklists. The first step in a proceeding under the Divorce Act and the Family Relations Act should be the completion of the "Family Practice Interview" checklist. Also, practitioners should consider the option of mediation or collaborative separation and divorce.
