OSHA regulations may be enforced by the Federal government or by the state if you are in an OSHA “State Plan” state. The OSHA General Duty Clause requires employers to provide a “place of employment ...free from recognized hazards that are likely to cause death or serious physical harm to his employees”. OSHA may sometimes cite an employer for not using an ANSI standard in conjunction with the General Duty Clause if compliance with the ANSI standard could have prevented or lessened the severity of an injury.
