1. Applicable Equipment: Lessor hereby leases to Lessee, and Lessee leases from Lessor, the following: (a) the equipment described on Exhibit A attached hereto (or similar document); and (b) any additional equipment which may be added to this agreement from time to time in accordance with Section 2 (Verbal Orders) below. Lessor may substitute Equipment under this agreement.
2. Verbal Orders: Lessee has requested that it be able to add additional Equipment to this agreement from time to time on an expedited basis without the need for a formal amendment to this agreement or execution of a new agreement. Such orders may be submitted to Lessor by, without limitation, telephone, facsimile, e-mail or orally. Whenever any such order is accepted by Lessor, Lessor will prepare a supplemental Exhibit A (or similar document) which describes the additional Equipment, rental term, rental rate and other applicable information, and transmit such supplemental Exhibit A (or similar document) by fax or e-mail, as applicable, to the following number or address designated by Lessee: (Exhibit A (or similar document) Sent Address).
Lessee agrees that such additional Equipment will be subject to this agreement and that the supplemental Exhibit A (or similar document) will be deemed accepted and to be part of this agreement, effective as of the first to occur of: (a) 24 hours after transmission of the supplemental Exhibit A (or similar document) to Lessee in the manner provided in the preceding sentence (unless within such time Lessee contacts Lessor and disputes any of the terms of the supplemental Exhibit A); (b) the time at which Lessee or a hauler arranged by Lessee picks up the Equipment from Lessor; or (c) 24
hours after delivery of the Equipment to Lessee or Lessee’s job site, if delivery is made by Lessor or a hauler arranged by Lessor.

3. Authorized to Rent: Lessee has requested that in order to add additional equipment to this agreement in any manner, the Lessee’s employee/representative must be on the Authorized To Rent list (exhibit B). Lessee will supply Lessor with list of persons who have authority to rent equipment in accordance with this agreement (Exhibit B). Lessor will not accept an order from anyone other than those on Authorized To Rent list. To be able to secure approval for an order placed by a representative of Lessee not on the Authorized to Rent list, the Lessor will contact the following designated person(s) in charge of rental:
